1. Agreement to These Terms
These Terms of Service (“Terms”) govern the services provided by Maritime HVAC (“we,” “us,” “our,” or the “Company”) to the customer (“you,” “your,” or “Customer”). By requesting, scheduling, signing for, paying for, or accepting service, you agree to these Terms.
2. Our Services
We provide HVAC, plumbing, electrical, water treatment, and related home services. Services are performed according to the scope described in your estimate, work order, booking confirmation, or invoice (“Service Documents”).
If your requested work falls outside our offered services, or if site conditions are unsafe, we may decline or stop work.
3. Appointments & Access
You agree to provide safe, timely access to the service location, including accurate address details, parking/entry instructions, and any required keys, codes, or permissions. If access is not available at the scheduled time, we may treat the visit as a no-show.
You must disclose known hazards (e.g., asbestos, mold, pests, unsafe wiring, aggressive animals, unstable structures). We may reschedule or stop work if conditions are unsafe.
4. Estimates & Pricing
Estimates are based on the information available at the time and may change if conditions differ from what was described or observed. If additional work is required, we will explain the change and provide an updated price before proceeding, except where immediate action is required to prevent damage or restore safety and you have authorized such emergency work.
5. Payment Terms
Unless otherwise stated in writing, payment is due upon completion of the service visit or project milestone described in the Service Documents. We accept the payment methods listed on your invoice/receipt.
Late or unpaid balances may result in (a) paused work, (b) refusal of future bookings, and/or (c) late fees where permitted. Any third-party payment processing is subject to the provider’s terms.
We can provide invoices and receipts electronically by email/text when available.
6. Cancellation & No-Show
Please cancel or reschedule as early as possible. If you cancel within the timeframe stated in your confirmation (commonly 24–48 hours), a cancellation fee may apply to cover reserved time and dispatch.
If our technician cannot access the property at the scheduled time (no-show), we may charge a no-show fee to cover travel and time.
7. Parts, Materials & Subcontractors
We may use third-party parts, supplies, or subcontractors. Parts are typically covered by manufacturer warranties, which may have registration or maintenance requirements. We will inform you when practical if subcontractors will perform portions of work.
8. Warranty & Service Limitations
Labor and parts warranties (if any) are as described in your Service Documents. Warranty coverage does not apply to issues caused by misuse, neglect, unauthorized modifications, acts of nature, improper maintenance, or repairs performed by others.
Diagnostic fees, dispatch fees, and routine maintenance may be non-refundable unless required by law. If a manufacturer warranty applies, you may be required to provide proof of purchase/registration and allow reasonable troubleshooting steps.
9. Limitation of Liability
To the maximum extent permitted by law, our liability for direct damages is limited to the amount you paid us for the specific service giving rise to the claim within the twelve (12) months before the event. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, loss of use, or business interruption.
10. Indemnification
You agree to indemnify and hold Maritime HVAC harmless from claims, damages, liabilities, and reasonable costs arising out of your breach of these Terms, negligence, or failure to provide accurate information, proper permissions, and safe access.
11. Intellectual Property
Our trademarks, logos, and content remain our property (or our licensors’ property). You may not use our branding or content without written permission, except as needed to receive the services described here.
12. Privacy & Data
We collect and use personal information to schedule, perform, and bill for services and to communicate with you. Our handling of personal information, including SMS/text consent and opt-out options, is described in our Privacy Policy.
By providing your contact information, you consent to service-related communications (appointment confirmations, technician updates, invoices/receipts). Marketing messages, if any, require appropriate consent and include opt-out instructions.

13. Disputes & Governing Law
These Terms are governed by the laws applicable in the jurisdiction where the service is performed, unless the Service Documents state otherwise. We prefer to resolve issues informally first — please contact us and we’ll try to make it right.
If a dispute cannot be resolved informally, the parties may pursue available remedies under applicable law. Nothing here prevents either party from bringing a claim in small claims court where permitted.
14. Changes to These Terms
We may update these Terms from time to time. We will post the updated version with a revised effective date. Continued use of services after the effective date constitutes acceptance of the updated Terms.
15. Termination
We may suspend or terminate services for nonpayment, unsafe conditions, or material breach of these Terms. Termination does not remove your responsibility to pay for work already performed and materials already ordered for your project.
